Public Records Law Exemptions                                (Confidential Records/Information)

The items listed below are exemptions to Florida's Public Records Law as found in the Florida Statutes and summarized in the 2004 Government-in-the-Sunshine Manual. All statutory references refer to the Florida Statutes. The specific statute reference is included for those desiring to read the entire section.

PUBLIC RECORD LAW EXEMPTIONS

  • All birth records of Florida. (Chapter 382.025(1))
  • Personally identifiable records or reports of the student and any personal information contained therein. (Chapter 1002.22(3)(d))
  • Cumulative records of public school students. (Chapter 1003.25(1))
  • Information contained in an application for determination of eligibility for the Florida Kidcare program. (Chapter 409.821)
  • Identifying information, including medical records and family financial information, obtained by the Florida Healthy Kids Corporation. (Chapter 624.91(8))
  • Hearings on exceptional student placement or denial of placement in special education programs. (Chapter 1003.57(5))
  • Hearings challenging the content of student records and reports. (Chapter 1002.22(3)(c))
  • Student expulsion hearings. (Chapter 1006.07(1)(1a))
  • Tests and related documents developed to measure and diagnose student achievement of college level communication and computation skills. (Chapter 1008.345(8)(h))
  • Examination and assessment instruments, including developmental materials and work papers. (Chapter 1008.23)
  • Information that may identify a student or employer which is contained in a follow-up study on job-related vocational instruction. (Chapter 1008.39(3))
  • Information relating to the provision in the school health services plan developed for maintenance of health records of individual students. (Chapter 381.0056(5)(p))
